1. SERVICES AND CONDITIONS OF USE

RoseColours Cosmetics web site is a service which allows the individual consumer (the Customer") to order products (the "merchandise") supplied to RoseColours Cosmetics by independent merchandise vendors (the "Vendors"). RoseColours Cosmetics is a trademarked name. By placing an order in this site, you acknowledge that the Vendors are responsible for the fulfillment of all Merchandise ordered, and that the Vendor, not RoseColours Cosmetics is responsible for merchandise shipments. All Merchandise advertising claims and specification are those of their respective Vendors, not RoseColours Cosmetics. All of the merchandise offered is subject to availability. Neither RoseColours Cosmetics nor its vendors are responsible for errors in copy or images. 2. PRICE AND PAYMENT

Customer agrees to pay all amounts accrued from their purchase at RoseColours Cosmetics, including applicable sales tax and shipping and handling charges as they are defined at the time of purchase. RoseColours Cosmetics reserves the right to decline service.

RoseColours Cosmetics reserves the right to modify the prices of any of the product shown on the site.

Customer agrees that RoseColours Cosmetics may bill your credit card at the time merchandise is ordered.

Customer also acknowledges that RoseColours Cosmetics and its Vendors are not responsible and shall not be held liable for any breaches in transaction security by third parties.

3. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY

Customer agrees that the use of the RoseColours Cosmetics site and the purchase of the products within are made at the Customer's own risk. The merchandise at RoseColours Cosmetics is made available for purchase "as is" without warranty of any kind beyond our "Satisfaction Guarantee". RoseColours Cosmetics. may not be accountable for any damage liability, direct, indirect, or consequential, that may arise from the purchase of any merchandise, including, but not limited to the use of the RoseColours Cosmetics web site, or the use of any merchandise.

4. NOTICE

RoseColours Cosmetics may give notice to Customers through electronic mail to the Customer directly, or notice by a general posting on the site or by written notice by electronic mail to the email address indicated on a Customer order or by written notice by first class mail to a Customer billing address in our records.

5. TRADEMARKS

RoseColours Cosmetics and its logos are the trademarks of RoseColours Cosmetics. All other trademarks appearing at RoseColours Cosmetics are the property of their respective owners.

6. INDEMNIFICATION

Customer agrees to indemnify and hold RoseColours Cosmetics, its successors, assigns, affiliates, employees, and directors harmless from any dispute that might arise from a breach of this Agreement, and RoseColours Cosmetics shall not be held accountable for any expenses associated with such claims, including but not limited to attorney fees, court costs, and other expenses associated with the use of the RoseColours Cosmetics web site or any claims made regarding agreement breach.

7. CHOICE OF LAW

This Agreement shall be controlled and interpreted by and under the laws of the state of Virginia; the laws of the state of Virginia shall govern any disputed regarding this agreement or RoseColours Cosmetics.

8. MERGER CLAUSE

RoseColours Cosmetics may amend or modify this agreement at any time upon notice to Customer as published on the web site. Any use of the RoseColours Cosmetics web site shall be deemed acceptance of the terms of Agreement at that time.
